For leaks that happened before the settlement's effective date, the original past-claim deadline has already passed. However, you can still file for any new qualifying leaks that occur during the claim period, within 150 days of when each leak happens.

What counts as a qualifying leak?

A leak from NIBCO's PEX tubing (1006 formulation, including NIBCO NEXT-Pure and DURA-PEX), their yellow brass ASTM F1807 fittings, or their stainless steel clamps, in a US residential or commercial structure. The tubing was manufactured until 2012; fittings and clamps until 2015.

How much will I actually get?

The settlement pays 25% to 70% of your reasonably proven property damage. The exact percentage depends on the details of your claim. The settlement fund totals $43.5 million, which also covers attorneys' fees, administration costs, and plaintiff service awards, so individual payouts vary.

I've had multiple leaks. Can I claim for all of them?

Yes, and if you've had three or more separate qualifying leaks, you may also qualify for a re-plumb payment covering between 25% and 70% of the cost to re-plumb your structure.

My insurance company paid for the damage. Can they file a claim?

Yes. Subrogated insurance carriers are explicitly included in the settlement class and can file claims for damage they already paid out.
