NIBCO PEX Tubing Settlement
If NIBCO PEX tubing, fittings, or clamps in your home or building leaked and caused damage, you can file a claim for reimbursement. The settlement fund is up to $43.5 million. For future qualifying leaks, you have 150 days from the date of each leak to file.
Official eligibility wordingYou may be a class member if you have owned or occupied at any time since January 1, 2005 a residential or commercial structure in the United States that contains or contained NIBCO's Pex Tubing, Fittings or Clamps, and you have unreimbursed costs or damages from water leaking, or you repaired or paid to repair such damage. - Who may qualify You may qualify if, at any time since January 1, 2005, you owned or lived in a US residential or commercial building that had NIBCO PEX tubing, fittings, or clamps, and you suffered unreimbursed water damage from a leak in those products. Contractors, builders, and subrogated insurers who covered NIBCO-related damage are also included. Note: certain D.R. Horton homes in Alabama and Continental Homes properties in Texas are excluded.

- Certain properties in Alabama and Texas built by D.R. Horton or Continental Homes are explicitly excluded from the settlement class — verify your address is not on the exclusion list
- Claims for past leaks had a deadline of 150 days after the Effective Date; for future leaks the deadline is 150 days after the qualifying leak occurs — missing this window forfeits your claim
- Payment is not a fixed amount but a percentage of Reasonably Proven Property Damage — you must substantiate your actual costs
- A re-plumb payment requires demonstrating three or more qualifying leaks, each occurring at a separate time after repair
