Travelers New Mexico Underinsured Motorist (UIM) Settlement

Travelers has settled a New Mexico class action alleging it sold misleading underinsured motorist (UIM) coverage and improperly applied offsets against UIM benefits. If you had a Travelers auto policy with UIM coverage in New Mexico between 2015 and 2022, you may be able to claim a partial premium refund or a claim re-evaluation.
Official eligibility wordingYou may be eligible if you were insured under a New Mexico automobile insurance policy issued by Travelers or its listed affiliate companies that included underinsured motorist (UIM) coverage between January 1, 2015, and August 16, 2022. Officers and directors of the defendants, class counsel, defense counsel, the judge, and their resident relatives are excluded. - Estimated payoutClass members other than wrongful-death claimants may elect either payment under a premium formula — 29% of all UIM premiums paid during the Class Period — or payment under a claim formula, in which the UIM claim is readjusted without the UIM offset applied (depending on your damages you may receive less than the offset, or nothing). For claims involving wrongful death, Defendants will auto-pay the UIM offset to the extent any offset was applied.
