Liberty Mutual $6.5 Million New Mexico UM/UIM Settlement

1. Determine which subclass you belong to: offset subclass (UIM claim was reduced by amounts the at-fault driver's insurer paid) or direct premium refund subclass (purchased UM/UIM coverage but had no claim offset).
2. If you are in the direct premium refund subclass, no action is required — payments are processed automatically.
3. If you are in the offset subclass, complete the claim form either online at the settlement website or by downloading and printing the PDF claim form.
4. On the claim form, certify under penalty of perjury that you made a UIM claim that Liberty, its affiliates or Safeco reduced by the amount the at-fault driver's insurer paid.
5. Provide the date of the crash or loss and your signature on the claim form.
6. Submit the completed form online or mail it to the settlement administrator at the address provided: Crutcher v. Liberty Mutual Insurance Co. et al., Settlement Administrator, P.O. Box 5338, Portland, OR 97228-5338.

What the form asks

• — A sworn statement that you made a UIM claim that Liberty, its affiliates or Safeco reduced by the amount the at-fault driver's insurer paid (Your own recollection and any correspondence or explanation of benefits from Liberty Mutual or Safeco regarding the offset applied to your UIM claim)
• — The exact date of the motor vehicle accident for which you filed the UIM claim (Police report, insurance claim paperwork, or any documentation related to the accident)
• — Your handwritten or electronic signature (Sign personally — this accompanies the sworn certification)

Watch out for

• Offset subclass members who miss the claim deadline forfeit their right to payment — direct premium refund subclass members are paid automatically and do not face this risk.
• If total valid offset subclass claims exceed the subclass cap, each payment will be reduced proportionally (pro rata), so your actual payment may be less than the maximum.
• If your contact information changes after submitting a claim form, you must notify the settlement administrator to ensure you receive payment.
• Payments are distributed only after the court resolves any appeals and grants final approval — no payment date is guaranteed.
