• Who may qualify You may be covered if, during the settlement class period, you were in the United States and got more than one text message in any 12-month period from or on behalf of USA Clinics Group about its goods or services — either after you told them to stop by replying with "stop" or a similar opt-out, or while your number had been on the National Do Not Call Registry for at least thirty days without your permission to be contacted. If you got an email or postcard notice, the company's records already point to you.
• Estimated payoutUSA Clinics Group agrees to make a capped settlement fund available to pay Settlement Class Members who submit valid Claim Forms; pay notice and administration costs; pay attorneys' fees and costs awarded to Class Counsel; and any service award approved for the class representative. Settlement Class Members who submit a timely, valid, complete, and verified Claim Form will receive a per-text-message payment with a cap of three messages per person. Settlement Class Members may only submit one Claim Form, which will cover all text messages (up to three) to any of their telephone number(s). If the Settlement Fund is insufficient to pay the full per-message amount for all approved claims, the per-message amount will be uniformly reduced on a pro rata basis.
